Definitions - "The Company", "me", "I", "us" or "we", means James Smith, Cheaper-Scripts, and/or our shop; "the customer", "you" or "client", or "end user", refers to a purchaser of a design or script, or its intended recipient if other than the purchaser; "Ownership" refers to the rights to use a design or script.

Copyright - Copyright in a design or script, created by the company, will always belong to the company. Copyright does not, under any circumstances, pass to the customer. This applies whether or not you purchase an exclusive license or master rights.

Ownership - When you purchase a design or script, ownership passes from the company to the customer. Ownership does not entitle you to re-sell the design or script, as you are not purchasing the copyrights, or re-sale rights.

License - The Company grants you non-exclusive limited license to use the web templates and other products sold through our web site in accordance with these Terms and Conditions (the "license") issued by the company.

Limited Usage - As the owner of the rights to use a design or script, you are granted express permission to use the design or script in any way you wish. You may alter or edit the design or script to suit your own needs or purposes. You may use the design or script for yourself on a single website, or if the design or script is intended for a recipient other than the original purchaser, then on a single website belonging to the end user or final recipient.
If you purchase a design or script intended to be used on a clients site, then subsequently wish to use the same design or script on another client site, then you must re-purchase that design or script. You can avoid this requirement by purchasing the design or script as an "exclusive" license or master rights. If you are a commercial web-developer/programmer who wishes to use the design or script for multiple client sites, you must either re-purchase the design or script for use on additional sites, or purchase the design/script exclusively, after which you may use it as many times as you wish.

Limitations - You may not:

• make the design or script available for download, whether free or paid for
  
• re-sell the design or script whether as a stand alone offering, or as part of a package in ANY media format
  
• you may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are the property of the company. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall we be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
  
• place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind
  
• You may not sub-license, assign, or transfer this license to anyone else without prior written consent from the company

Refund Policy - Since we are offering non-tangible, irrevocable goods we do not issue refunds after the product is shipped, which you are responsible for understanding upon purchasing any product at our site. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week after the delivery date.

Our company reserves the right to change or modify these Terms with no prior notice.

Recourse - As an infringement of these terms and conditions has the potential to deprive me of a substantial amount of income, any person found to be in violation of these terms and conditions, will be prosecuted to the fullest extent allowable by law.

Disclaimers - I have no control over the use to which these templates or scripts are put by any purchaser, therefore I do not accept any responsibilty for the use to which they may be put by any purchaser, including, but not limited to, offensive sites, illegal sites, and/or any loss or damage resulting from same.
